The Lessor reserves the right to annul any and all contracts until delivery of the instrument(s) is made to the Lessee.

Moog Audio shall abide by early reservations only if the contract is duly signed beforehand and a deposit is made in cash or by certified cheque. If a cancellation is made less than twenty-four (24) hours before delivery, the Lessor shall retain the deposit made as compensation for damages.

The Lessee undertakes to maintain the rented instrument(s) in good working order up to the expiration of the present contract.

The Lessor shall in no way be held responsible by the Lessee for any breach of one of its obligations.

The deposit made by the Lessee shall be remitted to him without interest if the instrument(s) is/are returned to the Lessor in good working order on or before the specified return date.

The Lessee shall be held responsible for the designated value of the instrument(s) if for any reason whatsoever said instrument(s) is/are not returned to the Lessor within a reasonable delay, the value to be determined by the Lessor.

The instrument(s) shall be returned no later than the date specified as return date on the recto side of the contract; and any delay shall be penalized without exception by charging overdue rent at double the pro-rata daily rate, said overdue rent to be deducted from the deposit, and the balance becomes due immediately.

Rental payments do not apply to eventual purchase of instrument(s) unless a contract is drawn up to that effect.

The Lessee shall also be held responsible for any damage to the instrument(s) beyond normal expected wear. Damage costs shall be deducted from the deposit, the balance becoming immediately payable by the Lessee. The value of said instrument(s) is to be estimated by the Lessor.

Leased instrument(s) requiring any repairs whatsoever shall be returned to the Lessor who alone shall effect such repairs and, except for repairs of damage caused by normal expected wear, the Lessee shall be held responsible for payment of such repairs. The Lessee shall also be held responsible for any damages due to non-authorized repairs or adjustments made as well as damages due to negligent and unskilled repairs and adjustments.The Lessor reserves the right to inquire as to the whereabouts of the aforesaid instrument(s) and to inspect them. The Lessee undertakes not to sub-lease or lend the aforesaid instrument(s) without the written authorization of the Lessor.

If, for any reason whatsoever, the Lessee defaults in any of his obligations, the Lessor shall at any time take possession of the aforesaid instrument(s) without resorting to legal or judicial procedure.

The Lessee shall be held responsible for payment of any fees or costs incurred by the Lessor in repossessing the said instrument(s) or in the recovery of rental arrears.

The Lessee undertakes to pay transportation costs if the instrument(s) is/are returned by a third party.

This Agreement is not renewable without the written consent of the Lessor to that effect within twenty-four (24) hours before the termination of the present Agreement.

The Lessee undertakes to advise the Lessor of any change of address.

Title to the said instrument(s) shall at all times remain with the Lessor. The Lessee shall immediately notify the Lessor should said instrument(s) be seized, stolen, broken or subject to seizure for any reason whatsoever.

It is further agreed by and between the parties hereto that any litigation arising out of or by virtue of this Agreement shall be tried at the location designated by the Lessor.

Liability for injury, disability and death of anybody caused by the operation, handling or transportation of the instrument(s) during the rental period shall be assumed by the Lessee and he shall indemnify the Lessor against all such liability. The Lessee shall also indemnify the Lessor against all loss, expense and penalty arising from any action on account of damage to property caused by the operation, handling or transportation of any instrument during the rental period.
